The use and possession of police scanners by private citizens has been regulated in Michigan under the Michigan Penal Code Act 328 of 1931. A violation of this section is considered a misdemeanor and could result in fines of up to $1,000 and imprisonment of up to a year or both.
It is a crime to possess a police scanner during the commission of a felony or a misdemeanor. If the crime being committed is punishable by more than one year in jail then the police scanner possession is considered a felony. The punishment is up to two years in jail and a fine of up to $2,000 or both. If the crime is punishable by a maximum 93 days to one year then the scanner possession is considered a misdemeanor with punishment of up to one year in jail and a fine of $1,000 or both.
